Brain Injuries

San Diego Brain Injury Attorney

Approximately 1.4 million people in the United States sustain a traumatic brain injury each year, according to the Brain Injury Association of America. Approximately 235,000 of these individuals require hospitalization, and roughly 50,000 succumb to their injuries and expire. A traumatic brain injury is a severe injury or blow to the head which, although it causes no identifiable fracture to the skull, results in significant and/or irreparable damage to the brain.

One of the cruel ironies of brain injuries is that many victims that sustain them appear to retain normal functionality. Unfortunately, these individuals have a profoundly disabling brain injury that results in memory loss, cognitive impairments, and emotional and behavioral changes that leave the affected individual unable to earn a living, and some cases, unable to accomplish the required tasks of daily life.

There are two primary brain injury types:

Traumatic Brain Injuries

A traumatic brain injury occurs when an external force impacts the head with enough force to cause the brain to move within the skull, or alternatively, causes the skull itself to break causing direct harm to the brain. Several types of injuries can produce traumatic brain injuries including:

  • Car, truck or motorcycle accidents
  • Physical violence
  • Cycling accidents
  • Sporting accidents
  • Direct trauma to the head

Symptoms associated with traumatic brain injuries often include:

  • Temporary loss of consciousness
  • Pupil dilation

Acquired Brain Injury

Unlike a traumatic brain injury, an acquired brain injury takes place at the cellular level within the brain. That is, acquired brain injuries affect the cells throughout the entire brain as opposed to traumatic brain injuries which only affect a specific part of the brain. There are also two types of acquired brain injuries: Anoxic Brain Injuries, which occur when the brain is completely deprived of oxygen, and Hypoxic Brain Injuries, which occur when the brain receives some but not enough oxygen.

Causes of Acquired Brain Injuries can include:

  • Airway obstructions
  • Choking or strangulation
  • Drowning
  • Shock
  • Head or neck trauma
  • Vascular disruption
  • Heart attack or stroke
  • Infectious disease
  • Brain tumors
  • Metabolic disorders
  • Meningitis
  • Exposure to toxic agents
  • Drug Use

Everything Matters

Foldenauer Law Group has recovered millions of dollars in settlements and awards for our clients. We have built our success on nearly 20 years of experience as Plaintiff’s only injury attorneys, and have a proven ability to recover maximum damages. It’s no accident. We work exceptionally hard to obtain extraordinary results.

Our attorneys go far beyond the standard methods normally used in personal injury cases. We conduct a complete investigation of the accident which includes visiting the accident scene, photographing and preserving evidence, measuring distances, calculating speeds, G forces, and interviewing witnesses. We take the time because well-documented facts build better liability cases. When needed, we utilize testimony from leading experts, such accident reconstructions, medical doctors, forensic accountants and economists for our winning team.

We seek out creative recovery solutions, which includes collecting from all individuals and entities that have responsibility for the accident – not just the one obvious defendant. When an insurance company refuses to make a fair settlement on a case –  we do not cower. We are always ready to take our cases to trial. We have the financial resources needed to fund our cases. This puts our injury clients on a level playing field with even the largest insurance companies. We are very proud of our winning trial record and believe it gives us extreme credibility when negotiating large settlements with insurance companies.

We are not a “personal injury mill” that focuses on the quantity of injury cases it handles. We are selective. We limit the number of injury cases we accept at any given time to ensure that our clients’ cases receive the extra time and effort needed to achieve extraordinary results.

To us – everything matters.
