Our Approach To Personal Injury Cases

We are not an injury mill—which is also commonly referred to as a settlement mill. Those are firms that prioritize volume. This is not an uncommon business practice that exists throughout our economy. Think of a large department store that sells a wide variety of products. They sell everything for a relatively low cost. Although the store doesn’t make a significant amount of profit off each sale, it can generate substantial revenue through the sheer amount of sales each day. 

Compare that to a smaller boutique store that sells very few products at higher costs—presumably because their products are higher quality. Although we are not making accusations or claims against firms who seek out volume, it is simply not how we choose to run ours. 

Unlike the large department stores, boutique law firms like ours do not charge more for our services; we offer a more personalized approach to your case. Settlement Firms

Before you can understand how the Foldenauer Law Group, APLC, is different from settlement firms, you must know how they operate. Settlement firms have case managers and intake professionals. These people cannot offer you legal advisors because they are not attorneys. Their role is to get you into a contractual agreement. 

Case managers often draft demand letters—which an attorney approves but does not usually write. When you work with a settlement firm, you may not actually speak with an attorney unless you have a question about the settlement. 

The driving force behind a settlement firm is to settle out of court. This is by design. Because they deal with such a high volume of cases, they cannot afford to spend days to weeks in court. The opportunity cost of devoting that much time to a trial is not cost-effective and is not part of their business model. 

Our Guiding Principles

We limit the number of cases we take. Our decision to operate this way is rooted in a desire to give each client the attention and focus they deserve. Each person’s circumstances are unique, and there is no way of knowing where the case will lead. If a case demands that we spend most of our time on it, we can do that. To prioritize volume would be counterproductive to that specific client’s needs. 

We Put Together a Package

Saying that we are fully invested in your case is not empty rhetoric. Each case may require a significant amount of research and work. Imagine a client coming into our firm because they suffered a broken leg due to another person’s negligence. It is an incredible oversight to assume this client simply needs us to make a phone call, set a meeting, and get a settlement. 

We are going to handle the case properly. That means that we are prepared to contact medical experts that can explain the true extent of the injuries and how they will impact your life. We have a vast network of people within the medical community that will assist you and us. This includes surgeons, physical therapists, and nurses. Although we can take their expertise and fight your case accordingly, you deserve to have them speak to your injuries. 

The person who is legally obligated or responsible for compensating you for your injuries may not be readily apparent. Is the other driver at fault, or was there an existing condition (created by another party) that caused the other driver to hit you? These are the questions that need to be answered. And they will be included in the package we assemble for your case.
